On January 20, 2014, the Ministry of Commerce issued the No. 5 announcement of the year, and decided to impose anti-dumping duties on imported solar grade polysilicon originating in the United States and South Korea from January 20, 2014.
On February 14, 2016, Jiangsu Zhongneng Silicon Technology Development Co., Ltd., Jiangxi Saiwei LDK Photovoltaic Silicon Technology Co., Ltd., Luoyang Zhongsi High-Tech Co., Ltd., Chongqing Daxin Energy Co., Ltd. (hereinafter referred to as domestic industry applicants) The Ministry of Commerce filed an application, claiming that the amount of solar-grade polysilicon dumped by South Korea to China after the final ruling increased, exceeding the final anti-dumping tax rate, requiring dumping of anti-dumping measures applicable to imported solar-grade polysilicon originating in South Korea. And the review of the dumping margin.
According to the provisions of Article 49 of the Anti-dumping Regulations of the People's Republic of China and the Provisional Rules for the Mid-term Reexamination of the Dumping and Dumping Range of the Ministry of Commerce, the Ministry of Commerce shall continue to follow the qualifications of the applicants, the export prices and normal values ​​of the products for investigation. The level of measures to implement anti-dumping measures and other relevant circumstances were reviewed. The Ministry of Commerce requires domestic industry applicants to submit relevant evidence materials; the applicant submits relevant materials within the prescribed time limit.
On November 1, 2016, the Ministry of Commerce notified the Korean Embassy in China of the application for mid-term review of dumping and dumping margins, and forwarded the public copy of the mid-term review application and the non-confidential summary of the confidential information. Relevant stakeholders submitted comments on the mid-term review.
The Ministry of Commerce has concluded that the application complies with the statutory conditions of the Anti-Dumping Regulations of the People's Republic of China and the Interim Rules for the Interim Review of the Dumping and Dumping Amplitude. The Ministry of Commerce has decided to start the mid-term review of the dumping and dumping margins for the anti-dumping measures applicable to imported solar grade polysilicon originating in South Korea from the date of this announcement. The relevant review matters are hereby announced as follows:

I. Review and investigation of product range The mid-review product range of this dumping and dumping margin is imported solar grade polysilicon originating in South Korea. The detailed description is consistent with the product description specified in the No. 5 Announcement of the Ministry of Commerce in 2014.
II. Review and investigation period The investigation period of the mid-term review of the dumping and dumping margin is from January 1, 2015 to December 31, 2015.
Third, the review process (a) stakeholder comments.
Any interested party may submit a written opinion on this review within 20 days from the date of publication of this announcement and provide evidence accordingly.
(2) Questionnaire issuance.
In order to obtain the information it needs to investigate, the Ministry of Commerce will send a questionnaire to relevant stakeholders as needed. The questionnaire can be downloaded from the “Case Dynamics” section of the Trade Relief and Investigation Bureau sub-site of the Ministry of Commerce (http://trb.mofcom.gov.cn). The responses to the questionnaire should be submitted in accordance with the questionnaire within 37 days after the date of transmission of the questionnaire.
(3) Hearings.
Interested parties may submit written requests for hearings in accordance with the "Anti-dumping Regulations of the People's Republic of China" and the "Provisional Rules for Anti-dumping Investigation Hearings" of the Ministry of Commerce. The Ministry of Commerce may also hold a hearing when it deems it necessary.
(4) Field verification.
The Ministry of Commerce will send staff to the relevant countries for on-the-spot verification when necessary; any materials submitted by the interested parties shall include a statement agreeing to the verification; the Ministry of Commerce will notify the relevant countries and enterprises in advance of the verification.
IV. Consequences of Non-cooperation According to Article 21 of the Anti-Dumping Regulations of the People's Republic of China, when the Ministry of Commerce conducts an investigation, the interested parties shall truthfully report the situation and provide relevant information. If the interested party fails to truthfully report the situation, provide relevant information, or fails to provide necessary information within a reasonable time, or otherwise seriously obstructs the investigation, the Ministry of Commerce may make a ruling based on the facts already obtained and the best information available. .
